Terms for Sellers

This policy is a part of our Terms of Use. By shopping on Altamira, you’re agreeing to this policy and our Terms of Use.

 

1. Selling Basics

a. What can be sold on Altamira

Altamira is a marketplace for original art. Everything listed for sale on Altamira must be original art.

Original art is art that you made or designed. 

If you sell art on Altamira, you agree that you made or designed the art. This means that you are using works, photographs or video you created, own, or have the rights to sell — in other words, not stock photos, artistic renderings, or photos or videos owned or used by other sellers or sites. 

b. What Can't be Sold on Altamira

Even if they otherwise meet our marketplace criteria, prohibited items, counterfeits, and items that violate intellectual property law are not allowed to be sold on Altamira.

Keep in mind that members may flag listings that appear to violate our policies for Altamira’s review. Altamira may remove any listings that it believes, in its sole discretion, violate our policies. Altamira may also suspend or terminate your account for any violations, as determined in its sole discretion. Regardless of removal, suspension or termination, you’ll still be on the hook to pay any agreed-to but outstanding fees owed to Altamira. 

c. Selling on Altamira

By selling on Altamira, you agree that you will:

Provide honest, accurate information

Ensure your content, such as any text, photos or videos used to represent yourself, your shop or your listings, abide by Altamira’s policies.

Accurately represent and describe your items.

Respect the intellectual property of others.

Promptly pay all fees owed

Not create duplicate accounts or take any other action (such as manipulating clicks, carts or sales) for the purpose of shilling, manipulating search or circumventing Altamira's policies.

d. Seller Standards By listing a product for sale on Altamira you understand and agree that you are responsible for complying with all applicable laws and regulations for the products you list for sale, including any required labels and warnings. Altamira assumes no responsibility for the accuracy, labeling, or content of your listings.

By selling on Altamira, you agree to:

Be available for shipping pick up and coordination.

If you are unable to complete an order, you must notify the buyer and cancel the order. After the first time this happens, your account will be reviewed. After the second time this happens, your account, at the sole discretion of Altamira, may be removed.

e. Selling Fees

Sellers may be charged for using some of Altamira’s services.

When you make a sale through Altamira, you will be charged a transaction fee of 10% of the price you display for each listing. The transaction fee will not apply to sales tax, Goods and Services Tax ("GST"), or Harmonized Sales Tax ("HST"). Transaction fees are deducted automatically as each sale occurs.

In the future, there may be fees associated with listing, selling, advertising, and certain other Altamira products and features. Altamira reserves the right to change the fee structure at any time.

2. Being a Member of the Altamira Community

Everyone is expected to treat fellow members of the Altamira community with respect. As a seller, you have additional responsibilities to safeguard personal information and communicate promptly with buyers in order to provide a great customer experience.

a. Creating and Uploading Content

As a member of Altamira, you have the opportunity to create and upload a variety of content, like critiques, text, photos, and videos. In order to keep our community safe and respectful, you agree that you will not upload content that is:

  1. Abusive, threatening, defamatory, or harassing
  2. Obscene or vulgar;
  3. In violation of someone else’s privacy or intellectual property rights; or
  4. False, deceptive, or misleading.

b. Privacy and Protecting Personal Information

You are responsible for protecting members’ personal information you receive or process, and you must comply with all relevant legal requirements. This includes applicable data protection and privacy laws that govern the ways in which you can use Altamira user information. 

If you disclose personal information without the buyer’s proper consent, you are responsible for that unauthorized disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer’s email address or other information as a result of entering into a transaction with that buyer. This information may only be used for Altamira-related communications or for Altamira-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer’s consent, and subject to other applicable Altamira policies and laws, you may not add any Altamira member to your email or physical mailing list, use that buyer’s identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance. If Altamira and you are found to be joint data controllers of personal information, and if Altamira is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify Altamira for the expenses it occurs in connection with your processing of buyer personal information.

c. Communication Standards

Critiques

Critiques may not be used for the following activities:

  1. Sending unsolicited advertising or promotions, requests for donations, or spam;
  2. Harassing or abusing another member

 

Any use of Altamira to harass other members is strictly prohibited. Critiques may not be used to support or glorify intolerance or hatred.

Communicating Cancellations

If you are unable to complete a transaction, you must notify the buyer via Altamira and cancel the transaction. If the buyer already submitted payment, you must issue a full refund.
